This Acceptable Use Policy (“AUP”) governs all use of the services, infrastructure, network, and
platforms provided by Vertahost (“we,” “us,” or “our”) through
vertahost.com and any associated subdomains or systems (collectively, “Services”).
This AUP applies to all customers, account holders, users, and any third parties who access or use our Services
directly or indirectly, including end users of customer-hosted websites and applications
(“you” or “users”).
By using our Services, you agree to comply with this AUP in full. Violation of this policy may result in
immediate suspension or termination of your account without refund, at our sole discretion. This AUP is
incorporated by reference into our Terms of Service.
2. Prohibited Content
You may not use Vertahost’s Services to host, store, distribute, transmit, or make accessible any
content that:
2.1 Illegal Content
Violates any applicable local, state, national, or international law or regulation
Infringes upon any copyright, trademark, patent, trade secret, or other intellectual property rights
Constitutes, facilitates, or promotes any illegal activity, including fraud, identity theft, or money laundering
Contains child sexual abuse material (CSAM) or any content that sexualizes or exploits minors in any way
Promotes, glorifies, or facilitates terrorism, violence, or hate crimes
2.2 Harmful or Offensive Content
Is defamatory, harassing, threatening, or abusive toward any individual or group
Promotes discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or national origin
Contains malware, viruses, ransomware, spyware, or any other malicious code
Is designed to deceive, mislead, or defraud users (including phishing pages and fraudulent storefronts)
Constitutes unsolicited commercial communications (spam) or facilitates bulk messaging operations
2.3 Privacy-Violating Content
Discloses private or personally identifiable information about individuals without their consent
Facilitates unauthorized data collection, surveillance, or tracking of individuals
Violates any applicable data protection or privacy law, including GDPR or CCPA
3. Prohibited Network and System Activities
The following activities are strictly prohibited on or through Vertahost’s infrastructure, regardless
of intent:
3.1 Security and Abuse
Conducting or facilitating unauthorized access to any system, network, or account (hacking)
Performing port scans, vulnerability scans, or intrusion attempts against systems you do not own or have explicit written permission to test
Launching denial-of-service (DoS) or distributed denial-of-service (DDoS) attacks against any target
Exploiting security vulnerabilities in Vertahost’s infrastructure or any third-party system
Intercepting, monitoring, or tampering with network traffic not destined for your account
Attempting to bypass or circumvent any security measure, authentication system, or access control
3.2 Resource Abuse
Consuming excessive server resources (CPU, RAM, disk I/O, or bandwidth) in a manner that degrades service for other customers
Operating cryptocurrency mining operations on shared or managed hosting environments
Running unauthorized background processes, daemons, or persistent scripts not related to your hosted application
Storing, transmitting, or processing data volumes that exceed your service plan limits without prior arrangement
3.3 Email and Messaging Abuse
Sending unsolicited bulk email (spam) from or through our Services
Operating an open mail relay or proxy that can be exploited for spam distribution
Forging email headers or otherwise misrepresenting the source of any message
Harvesting email addresses or other contact information without express consent
Using our infrastructure to facilitate phishing campaigns or social engineering attacks
4. Reseller and Customer Responsibilities
If you resell or provide access to Vertahost’s Services to third parties (your own customers), you are
fully responsible for ensuring that those end users comply with this AUP.
You must maintain your own acceptable use policy that is at least as restrictive as this AUP and make it available to your customers
You are responsible for promptly investigating and resolving any abuse complaints related to your customers’ use of your services
Violations by your end users may result in action against your account, up to and including suspension or termination
Vertahost reserves the right to contact your end users directly in cases of severe or ongoing abuse
5. Copyright and DMCA
Vertahost respects the intellectual property rights of others and complies with the Digital Millennium Copyright
Act (DMCA). If you believe that content hosted on our infrastructure infringes upon your copyright, please
submit a DMCA takedown notice to:
A description of the copyrighted work you claim has been infringed
The URL or location of the allegedly infringing content on our network
Your contact information (name, address, email, phone number)
A statement of good faith belief that the use is not authorized by the copyright owner
A statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner
Your physical or electronic signature
Counter-notices may be submitted by account holders who believe content was removed in error, in accordance
with DMCA procedures.
6. Reporting Abuse
We take abuse reports seriously and investigate all credible complaints. If you believe someone is using
Vertahost’s Services in violation of this AUP, please report it to our abuse team:
Please include as much detail as possible, including the domain or IP address involved, a description of the
abusive activity, and any supporting evidence (logs, screenshots, URLs). We will acknowledge receipt of your
report and take appropriate action in a timely manner.
Please Note
Vertahost does not disclose the outcome of internal abuse investigations to reporters. If you require law
enforcement involvement, please contact the appropriate authorities directly.
7. Enforcement and Consequences
Vertahost reserves the right to investigate any suspected violation of this AUP. Upon determining that a
violation has occurred, we may take one or more of the following actions at our sole discretion:
Issue a formal warning to the account holder
Temporarily restrict or throttle access to affected services
Remove or disable access to content that violates this AUP
Suspend the account pending investigation or remediation
Permanently terminate the account without refund
Report violations to appropriate law enforcement agencies
Pursue civil or criminal legal remedies where applicable
In cases involving imminent harm, illegal content, or serious security threats, we reserve the right to take
immediate action without prior notice, including immediate suspension or termination of services.
Vertahost’s failure to enforce any provision of this AUP on one occasion does not constitute a waiver
of our right to enforce it on future occasions.
8. No Liability for Third-Party Content
Vertahost acts as a conduit for customer-generated content and is not responsible for content hosted by
customers on our infrastructure. We do not pre-screen hosted content and do not assume editorial responsibility
for any material stored or transmitted through our Services.
However, we will act promptly upon receiving valid abuse complaints or becoming aware of content that violates
this AUP or applicable law.
9. Changes to This Policy
Vertahost reserves the right to update or amend this Acceptable Use Policy at any time. Material changes will
be communicated to active account holders via email and/or a notice posted on our website. Your continued use
of our Services following such notice constitutes acceptance of the revised policy.
We encourage you to review this AUP periodically. The effective date at the top of this page reflects the date
of the most recent revision.
